PRODUCT USE, WELLNESS INFORMATION & LIABILITY TERMS

1.) THC Wellness Products and Services

THC Wellness is a hemp and botanical products company. 
THC Wellness does not sell or provide marijuana, synthesized cannabinoids, or products formulated or marketed for the purpose of producing intoxication. 
THC Wellness does not operate 􀀆s a medical clinic, pharmacy, healthcare provider, medical-marijuana dispensary, or medical-caregiver service. 
Unless expressly stated otherwise for a particular product, THC Wellness products are intended for lawful personal use in accordance with their labeling, instructions, and applicable law. 

2.) Information for General Educational Purposes

Information provided through THC Wellness, including information appearing on the website, product pages, articles, educational materials, emails, customer-service communications, social media, or other communications, is provided for general product-information and educational purposes. 
THC Wellness does not provide medical diagnosis, medical treatment, prescriptions, or individualized medical advice. 
Information provided by THC W􀀋llness should not be considered a substitute for advice from a physician, pharmacist, or other appropriately licensed healthcare professional. 
If you have questions concerning a medical condition, prescription medication, medication interaction, pregnancy, breastfeeding, allergy, or other individual health circumstance, you should consult an appropriate healthcare professional.

THC Wellness does not represent that its products diagnose, treat, cure, mitigate, or prevent any disease or medical condition. 
Discussion of hemp, botanical ingredients, cannabinoids, terpenes, scientific publications, laboratory findings, traditional botanical information, or customer experiences does not constitute a representation that a particular THC Wellness product will produce a medical or therapeutic outcome. 
The availability of educational information concerning an ingredient does not mean that THC Wellness is recommending that ingredient or a finished product for treatment of a particular condition.

Customer testimonials, reviews, and reported experiences reflect the experiences or opinions of the persons providing them and do not guarantee that another customer will experience the same result. 

5.) Customer Responsibility and Safe Use

By purchasing or using a THC Wellness product, you agree to:                                                        •    review the product label, ingredients, warnings, and instructions before use;
•    use the product only as directed;
•    discontinue use if you experience a serious or unexpected reaction;
•    appropriately store products and protect them from unintended or unauthorized use;
•    use reasonable care if you have known allergies or sensitivities; and
•    seek appropriate professional assistance when circumstances warrant.

Do not drive, operate machinery, or engage in another activity requiring full alertness if you experience drowsiness, dizziness, reduced alertness, or another effect that could make the activity unsafe. 

6.) Medication and Health Considerations

Hemp-derived cannabinoids and botanical ingredients may interact with medications, supplements, alcohol, or other substances. THC Wellness does not determine whether a particular product is medically compatible with every prescription medication, medical condition, or individual circumstance. 
Customers who use prescription medications, have significant health conditions, are pregnant or breastfeeding, or have questions regarding possible interactions should consult an appropriate licensed healthcare professional before use. 
Nothing provided by THC Wellness should be interpreted as a recommendation to start, discontinue, increase, reduce, substitute, or otherwise change prescribed medical treatment.

7.) Drug Testing

Hemp products may contain naturally occurring cannabinoids consistent with the composition of the particular product.

Drug-testing results can vary based upon product composition, frequency of use, individual metabolism, testing methodology, detection thresholds, and other factors.

Unless THC Wellness expressly provides a specific written guarantee applicable to a particular product, THC Wellness does not guarantee that use of a hemp-derived product will not affect a drug test.

Customers subject to employment, military, athletic, professional, court, transportation, or other drug-testing requirements are responsible for considering those requirements before product use.

8.) Certificates of Analysis and Laboratory Information

THC Wellness may make certificates of analysis or other laboratory information available for certain products.

Laboratory reports relate to the sample, material, or batch tested and are provided for informational and quality-assurance purposes.

Laboratory information does not guarantee a particular physiological response, wellness outcome, or drug-testing result for an individual customer.

9.) Customer Reviews and Testimonials

Reviews, testimonials, comments, and other customer-submitted content represent the views and experiences of the individuals submitting them and do not necessarily represent the views of THC Wellness.

Submission of a review or testimonial does not convert a customer's statement into an authorized THC Wellness product claim.

THC Wellness reserves the right, subject to applicable law, to decline to publish or to remove content that is false, misleading, unlawful, inappropriate, or that attributes unauthorized medical or disease-treatment claims to THC Wellness products.

Nothing in these Terms requires THC Wellness to endorse statements submitted by customers or third parties.

10.) Third-Party Information and Links

The THC Wellness website may contain references or links to scientific publications, laboratories, manufacturers, healthcare resources, websites, or other third parties.

Unless expressly stated otherwise, THC Wellness does not control those third parties and does not guarantee the accuracy, completeness, availability, or continued accuracy of independently provided third-party information.

A reference or link does not necessarily constitute endorsement.

11.)Product Availability and Changes

THC Wellness may modify, reformulate, discontinue, replace, or change the availability of products when reasonably appropriate.

Product descriptions, packaging, ingredients, formulations, prices, and availability may change.

Customers should review the current product label and information accompanying the product rather than relying solely upon information concerning a previous formulation or purchase.

12.)  Misuse, Modification and Unauthorized Resale

THC Wellness is not responsible, to the extent permitted by applicable law, for lqss or injury resulting directly from:

       •       intentional misuse of a product;

•       use contrary to prominent product instructions or warnings;

•       unauthorized alteration, adulteration, or contamination after delivery;

•       improper storage after the customer assumes control;

•      unauthorized relabeling;

•                    •     unlawful resale or redistribution; or

•       unauthorized use by another person after the purchaser                          assumes possession.

Products are intended for lawful use.

EDUCATIONAL MATERIALS, AND RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, THC WELLNESS DISCLAIMS WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR CONTINUED AVAILABILITY OF GENERAL WEBSITE OR EDUCATIONAL CONTENT.

NOTHING IN THIS SECTION DISCLAIMS A WARRANTY OR CUSTOMER RIGHT THAT APPLICABLE LAW PROHIBITS THC WELLNESS FROM DISCLAIMING.

14.)  Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THC WELLNESS AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE WEBSITE, RELIANCE UPON GENERAL EDUCATIONAL INFORMATION, OR MISUSE OF THC WELLNESS PRODUCTS.

TO THE EXTENT PERMITTED BY LAW, THC WELLNESS IS NOT RESPONSIBLE FOR DAMAGES DIRECTLY RESULTING FROM:

•       FAIL URE TO FOLLOW PRODUCT WARNINGS OR INSTRUCTIONS;

•       INTENTIONAL MISUSE;

•       UNAUTHORIZED PRODUCT ALTERATION;

•       IMPROPER STORAGE AFTER DELIVERY;

•      CUSTOMER-PROVIDED INFORMATION THAT IS MATERIALLY FALSE;

•      USE CONTRARY TO INDIVIDUALIZED MEDICAL ADVICE PROVIDED BY THE CUSTOMER'S OWN HEALTHCARE PROFESSIONAL;

•      UNSAFE ACTIVITY AFTER EXPERIENCING AN EFFECT THAT MAKES SUCH ACTIVITY UNSAFE; OR

•       UNAUTHORIZED THIRD-PARTY USE AFTER THE PURCHASER ASSUMES CONTROL OF THE PRODUCT.

THE FOREGOING LIMITATIONS DO NOT EXCLUDE OR LIMIT LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT TO BE EXCLUDED OR LIMITED.

•       product safety;

•       truthful labeling;

•       mandatory product recalls;

•       fraud or intentional misconduct;

•       applicable consumer-protection laws;

•      legally enforceable express warranties; or

•       other non-waivable obligations.

If applicable law conflicts with a limitation in these Terms, the mandatory law controls.

16.) Product Complaints and Safety Concerns

Customers are encouraged to promptly contact THC Wellness regarding suspected product defects, contamination, unexpected reactions, packaging concerns, or other significant safety issues.

THC Wellness may request information reasonably necessary to investigate a complaint, including:

•       product name;

•       order information;

•      lot or batch number;

•       photographs;

•       remaining product; and

•      a description of the reported issue.

THC Wellness may preserve and evaluate such information for legitimate quality, safety, compliance, customer-service, and dispute-resolution purposes.

Reporting a safety concern to THC Wellness is not a substitute for seeking appropriate medical or emergency assistance.

17.) Emergency Matters

THC Wellness is not an emergency medical service.

If you believe that you or another person is experiencing a medical emergency, contact appropriate emergency services or another qualified emergency resource.

18.) Changes to These Terms

THC Wellness may revise these Terms from time to time.

The version applicable to a transaction will be the version presented or made available in connection with that transaction unless applicable law requires otherwise.

Material changes will apply prospectively unless otherwise permitted by law.

 

19.) Governing Law

To the extent permitted by applicable law, these Terms and transactions with THC Wellness are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Mandatory federal or other applicable law controls where required.

20.)  Severability

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be limited, modified, or severed to the minimum extent necessary, and the remaining provisions will continue in effect.

 

21.) Agreement to Terms

By accessing or using the THC Wellness website, creating an account, or purchasing products, you acknowledge that you have had access to these Terms.

Where THC Wellness requires affirmative acceptance during checkout, completing the applicable checkbox or other electronic acceptance process constitutes your agreement to the Terms applicable to that transaction.

Nothing in this provision limits rights that applicable law makes non-waivable.
